Did You Know…On what legal basis universities are facing lawsuits for failure to provide COVID-related tuition refunds? To show probable cause, many plaintiffs are pursuing a tortious action of educational malpractice. These actions question educational institutions in reference to their principles of duty, standards of care, and reasonable conduct. So, many of these lawsuits are proceeding by showing that the Defendant university committed educational malpractice by promising in-person classes and failing to deliver on such promise, without justly compensating their students for this diminished value in education. At this point, the adjudication of COVID-related education suits is mixed.
